TRLA Annual Meeting Recap

2011 Annual Meeting 1

Timberlake Ranch Landowners Association Annual Meeting was held on Saturday, May 28, 2011.  Landowners representing approximately 220 lots  in person or by proxy enabled the meeting to be held.  The wind and dust did not deter the Board of Directors from presenting their Annual Report to those in attendance. Special plaques of appreciation were presented to Jerry Toellner and Allen and Pat Burnam in recognition of the tremendous amount of volunteer hours each has given to the Timberlake community. 


Rhett Renoud joined the Board of Directors for a three-year term.

(8/26/11) TRLA Meeting Minutes and Treasurer's Report for July 2011 are posted below. Previous fiscal year's reports and other board relatied materials have been moved to the appropriate archrive pages.

(8/18/11) The latest version of New Mexico's CID Building Permit Guide for Residential Construction has been posted to the Building Construction page of the TRLA website. The most significant change for Timberlake landowners is a shed of 200 square feet can now be built without a building permit.

(8/4/11) Fire restricvtions lifted for Timberlake Ranch. Howver, to burn brush on your lot or trash without proper containment requires a burn permit from the Timberlake Volunteer Fire Department.


 

RESTRICTIONS ON SMOKING, FIREWORKS, CAMPFIRES, AND OPEN FIRE ARE IN PLACE!

(4/22/11) The Timberlake Volunteer Fire Department has received the following memorandum from the New Mexico Energy, Minerals and Natural Resources Department:

Due to abnormally warm temperatures, low humidity, high winds, and the abundance of dry fine fuels, fire danger through much of New Mexico is high.  Fire incidents for all wildland fire agencies are increasing daily.

SMOKING, FIREWORKS, CAMPFIRES, OPEN BURNING AND OPEN FIRES ARE PROHIBITED UNLESS THE FOLLOWING CONDITIONS ARE MET:

Campfires are prohibited unless the following exceptions are met.  An exception is granted where cooking or heating devices use kerosene, white gas, or propane as a fuel in an improved camping area that is cleared of flammable vegetation for at least 30 feet or has a water source.  Wood burning stoves must be equipped with approved spark arresters.

Fireworks are prohibited in wildland areas (lands covered wholly or in part in timber, brush, grass, grain or other flammable vegetation).

Smoking is prohibited except in enclosed buildings, within vehicles equipped with ashtrays and on paved or surfaced roads, developed recreation site, or while stopped in an area at least three feet in diameter that is barren or cleared of all flammable material.

(5/2/11) The Annual Meeting packets were mailed on April 29th. Rhett Renoud’s name was accidently left off his bio statement in the packet. No voting ballot was included because he is only candidate running for the one open seat. According to the TRLA Bylaws, he will join the board without having to hold an election.


(5/2/11) An energy efficient propane furnace and new duct work has been installed at the Bath House. The area is now up to code and heated economically along with new registers and a return on the men’s side.

(4/28/11) ROADS REPORT CORRECTION: The total amount of gravel spread on Buttonwood, Sunflower, Copperweed and Wolf Roads in October 2010 was 1,250.64 tons and not 515.07 as previously reported in the March issue of the Timberlake Times. I apologize for the incorrect report and for any concerns this may have caused.

(4/28/11) Timberlake Neighborhood Volunteer's Kickoff Meeting will be May 3rd at noon at the TCC Ranch House. All those interested in "Providing opportunities to foster community through volunteer opportunities" are welcome to attend and plan upcoming events, projects, and money making ideas. Bring a sack lunch.

(4/28/11) Timberlake's own Jim Zwerg will be a guest of Oprah Winfrey on May 4th. Tune in to see our local "celebrity".

(4/16/11) THE BATH HOUSE AND WELL ARE NOW OPEN. The bath house building has no heat as the new furnace has not yet arrived. ETA within two weeks.

Old GloryJune 23, 2010

Dear Landowners,

The Memorial Day Annual Meeting, held on May 29, 2010 had great weather except for an occasional wind gust that would send papers flying.  It was inspirational to have Old Glory flying over the ranch house for the first time ever and see the lake higher than it has been in several years. One third of the entire Association was represented in person or by proxy. 

Eileen Domer, Jerry Toellner and Mary Jo Wallen were elected to three year terms with 215/217/205 votes respectively.  A good time was held by all. The Board is now complete with all seven seats filled with four fulltime residents, two members with recreational homes and one who plans to build after retirement. 

We are now in the season of gnats and wishing for rain.  Please come prepared with anti-itch cream if you plan on camping.  A few residents feel they have the secret for keeping the gnats at a distance, but my personal experience has not been good with any of it.  A regular ole head net is about all that can protect you when working outside during the heat of the day as the gnats love the scalp and hairline.


There have been a lot of great fishing tales these last few months, but if you plan on fishing, I would encourage you to do it soon as the lake is receding due to irrigation of crops and the weeds are appearing.  An algae bloom may be imminent.

ARRIVED TODAY!

(6/25) The Assoication took delivery of the new Ford 550 multipurpose truck. It has a 9 ft. snowplow and dumpbed.

 

NEW COVENANTS ADOPTED

(Posted 7-31-09) The Board of Directors wishes to announce that at 10 am today (July 31, 2009) the final tally of votes for the adoption of the Amended and Restated Covenants, Conditions, and Restrictions was performed.  All five subdivisions exceeded the 75% affirmative votes required to adopt.  The following shows the actual totals.  

Cloh Chin Toh            77 Yes  (68 needed to pass)
Timberlake South         25 Yes  (23 needed to pass)
Cibola 1                       50 Yes  (47 needed to pass)
Cibola 2                       63 Yes (53 needed to pass)
McKinley 1-10          376 Yes (344 needed to pass)

The Board will be voting to accept the count after the Committee for the Revision of CC&Rs presents a signed document validating the numbers.  It will then be forwarded to Cassutt, Hays, and Friedman, PC for the additional legal wording at the end of the covenant document where representatives of the Board will sign in the presence of a Notary Public.  The law firm will then file the Amended and Restated Declaration of Covenants, Conditions and Restrictions with McKinley and Cibola County.

January 2010

The Snows of January!

The full force of winter is now upon Timberlake. 4WD, all wheel drive and/or chains are a necessity. Snow removal is a constant challenge with 38 miles of road to cover. The Board wants to sincerely thank Jack Mansperger for helping Jerry Toellner on the 30th of December to help clear the roads.


I want to make sure landowners realize what a gift Jerry Toellner, Danny Montoya, Tom Merritt and now Jack Mansperger have been for TRLA. These unselfish individuals have contributed a massive amount of volunteer hours to keep our roads passable. They say volunteers are unpaid – not because they are worthless – but because they are priceless.


Some of you have verbally called to thank them and I know how much they appreciate that, but unfortunately it is that one call of complaint or not doing enough or saying it should have been done a different way that can leave a bigger imprint. Take time to thank these wonderful volunteers.


TRnews tries to keep landowners abreast of road conditions. The “S” curve still remains a major problem with snow pack covering ice below. Several have experienced it first hand in having to ask for assistance to help remove their vehicles from the ditch. It is neighbor helping neighbor.


The Board is anticipating delivery of a new Ford 550 4x4 truck with a 9’ dump bed and a 9’ snowplow the end of February. We will be trading in the current TRLA pickup. This new piece of equipment will greatly improve the speed and ability to remove snow from the roads. Competitive financing is being explored to obtain the best possible deal. For over a year the Board had been looking for a comparable “preowned” vehicle around the country, but was unable to find a reliable match. This new snowplow/dump truck will serve Timberlake well for many years to come.

Dear Landowners,

At 10:00 this morning two years of hard work came to a positive end.  The morning was cool and there was a field of yellow gold flowers to the east and south of the Ranch House as 8 landowners with two observers tallied the last few votes.  Timberlake now has one set of Covenants. 

I can’t begin to thank all of you for making this happen and I plan to be more specific in the forthcoming August newsletter.  It was an absolute joy to talk to many of you on the phone or emailing during the second and third phase of voting and reading the notes attached to ballots as they were being tallied.  To realize that 84% of 742 lots voted is absolutely phenomenal.  That is double the percentage that voted in the last national election.  We should all take pride in this process that has reached a constructive finale.

IT'S UP TO YOU NOW!

The packets containing the new proposed Amended and Restated CC&R's were mailed today along with the yellow voting ballot with procedural rules, introductory letter and a return stamped envelope. I can't begin to tally the number of volunteer hours, stamps, paper, envelopes, paper cuts that made all this possible and most of all the Landowners who took the time to give us their feedback after each of the three drafts. It is you who gave the Committee the inspiration to help mold the framework of what the basics should be to keep our Timberlake an ideal place to visit, camp, live and invest in - to keep its beauty and retain its value. How many Landowners have the chance to truly develop their Covenants, Conditions and Restrictions after the fact? This is exactly what has occurred. The Developer turned over Timberlake Ranch to TRLA in 1991 leaving in place various sets of CC&R's as each subdivision was opened. They are outdated and ambiguous. This has caused costly legal problems and diversion of monies for infrastructure to pay attorneys, a lot of dissatisfaction and numerous disappointed Landowners over the last 18 years. Now the choice is in your hands. The Committee and the Board have done all they can do. We need 75% of Landowners to vote "yes". Regardless of how we vote, our land is still deed restricted. Do we really want to keep the old CC&R's that are confusing, outdated for today's home construction industry and unfriendly for recreational use or move into the 21st century with common sense restrictions that we as Landowners had a voice in making?

I am reminded of this paraphrased quote from Ed Koch, former Mayor of New York. "If you can agree with 80% of what I stand for, vote for me. If you agree with 100%, you probably need to see a psychiatrist." I hope you can see the humor in this analogy and I will be voting YES.
