TRLA SETTLES WITH GARCIA/SALAZ
     (Posted 10-14-06) On October 5, 2006, the Association, Robert and Jo Garcia, and Viola Salaz, Robert’s sister, signed a settlement agreement ending litigation that began December 2001 over the placement of Ms Salaz’s manufactured home on the Garcia’s lot. The agreement eliminates the pending trial before District Court Judge Foutz as directed by the December 2005 New Mexico Appeals Court decision. An Important Clarification of the TRLA Settlement with Garcia/Salaz
     (Posted 11-28-06) In two articles in the October, 2006 Timberlake Times, the Association stated in part that it had “successfully defended the current CC&Rs” and that “Robert, Jo and Viola had paid for their error.” This was a poor choice of words on our part; the Association did not mean to imply that either side had “won” the lawsuit. Rather, what we meant to communicate was that the parties had reach an amicable settlement of the dispute between them which provides significant benefits to both TRLA and to Robert and Jo Garcia and Viola Salaz. The Association sincerely regrets any misunderstandings or misimpressions, which these articles caused. --The TRLA Board of Directors

TRLA WINS AGAIN!
     (Posted 7-7-06) TRnews has recently learned that the lawsuit filed by plaintiff Mr. McGarry, a TRLA landowner, almost 8 years ago, against a number of defendants, including TRLA, both McKinley and Cibola counties, the developers, and a number of individual past TRLA directors has been dismissed by the court after the plaintiff withdrew. The case against TRLA challenged the validity of the CC and R’s, and TRLA’s authority to enforce them."
